Judge Mike Suttle Florence Alabama

Judge Mike Suttle modified an existing Tennessee court order for equal-shared custody with no legal basis in fact.

Mike Suttle was REVERSED by the Alabama Civil Court of Appeals because his ruling is plainly and deliberately wrong.

Twenty-seven months later the Alabama Supreme Court reinstated Mike Suttle's order.  Their decision was based solely on assumptions and inferences, and those are their words, not ours, the ore tenus rule.

The Alabama Supreme Court decision as outlined in this particular case is a violation of Due Process of the United States Constitution.

In February 2010, the Alabama Supreme Court denied - with no opinion - the father's Application for Rehearing that was based Due Process of the Constitution.  Read here what had been requested of the Alabama Supreme Court.

The father has ninety days to file a petition for review in the Supreme Court of the United States.

NOTE TO ALABAMA SUPREME COURT JUSTICES:

"Where the question presented on appeal is whether the trial court correctly applied the law, the ore tenus rule has NO application.
